On the fringes of copyright

The New York Times has an article about a chef who has tried to sue a competitor for infringement of intellectual property.

The suit…charges that Edâ??s Lobster Bar copies â??each and every elementâ?? of Pearl Oyster Bar, including the white marble bar, the gray paint on the wainscoting, the chairs and bar stools with their wheat-straw backs, the packets of oyster crackers placed at each table setting and the dressing on the Caesar salad.

There has been a growth in restaurants and chefs attempting to use of intellectual property arguments (copyright trademarks, patents and trade dress) to protect their businesses. As far as I have seen they have had little success.

Copying someone else’s bar or restaurant idea or menu may be a bit tacky and sad but this cannot be used to create intellectual property rights in these areas. If we were to begin protecting restaurants in this way then why not all parts of the service industry? Why stop there when we could begin using intellectual property to prevent our peers from dressing or behaving in the same way as we do?

Restaurants, food manufacturers, wine makers etc etc regularly explore, reverse engineer and learn from their competitors. There is no intellectual property limiting their ability to conduct these activities. Despite this lack of property protection there seems to be no limit to the amounts of human ingenuity and creativeness in relation to food and drink.

Maybe intellectual property should consider limiting the scope of protection and return to free market systems as opposed to creating false monopolies.

Millenium Mouse & Copyright

The attempts Disney goes to maintain copyright over their intellectual property are legendary. Copyright term extention acts have ensured that Mickey Mouse is saved from the public domain and continues to generate income for Disney.

But what would happen if Mickey was shown to be older than we thought? An artefact at Lund Historical Museum dated to 900 A.D. was excavated at a site called Uppåkra in southern Sweden.

Surprise, surprise its Mickey!! This means that Mickey is over 1000 years old – let Mickey enter the public domain – he deserves it…

Don’t be surprised if Disney uses this as an excuse to extend copyright terms to 1000 years!

Although made of bronze, the brooch ornament likely adorned the clothing of an Iron Age woman. Excavations at nearby sites, such as at Järrestad, have yielded other unusual pieces of jewelry, such as a necklace with a pail fob at the end and another necklace strung with 262 pieces of amber. Digital Sharecropping

George Lucas is joining the Web 2.0 bandwagon and allowing fans to create mashups of Star Wars. Wow, what a guy? Impressed? Happy? Don’t be!!!

â??Star Warsâ?? fans can connect with the Force in ways theyâ??ve only imagined beginning May 25, when StarWars.com launches a completely redesigned website that empowers fans to â??mash-upâ?? their homemade videos with hundreds of scenes from â??Star Warsâ?? movies; watch hundreds of fan-made â??Star Warsâ?? videos; and interact with â??Star Warsâ?? enthusiasts from around the world like never before.

With an innovative, interactive site that allows users to navigate to multiple â??Star Warsâ?? worlds, a new video focus, and groundbreaking â??Web 2.0â?? features â?? including a unique online multi-media mixing platform from Eyespot â?? the new StarWars.com will unveil its redesigned website on May 25 to commemorate the 30th anniversary of the â??Star Warsâ?? Saga.

Among the most compelling features of the newly redesigned StarWars.com is the incorporation of an online video-editing tool provided by Eyespot. It allows users to add their own video shots to more than 250 scenes and music taken from all six â??Star Warsâ?? films and create their own â??Star Warsâ?? movies to share with others.

Unfortunately the material the creative fans will create will not belong to them but will remain in the hands of George Lucas. The fan-created videos will run along with commercials profits split between Lucasfilm and Eyespot.

The idea of users being drafted, fooled, enticed into doing the work for someone else has been called digital sharecropping by Lessig. This refers to the situation where the work is carried out by poor day laborers while the landowners sit and reap the rewards of another’s creativity.

Open Source Cinema

Open Source Cinema is a collaborative documentary project to create a feature film about copyright in the digital age.

Several years ago, I began researching the intersection of culture and creativity – exploring how in the digital age, everything we know about copyright has been turned upside down. From mash-ups to filesharing, creation to distribution, everything is in flux.

 

This all came in to sharp relief when I attended the MGM vs Grokster oral argument in 2005. Outside, the music industry and file-sharing supporters alike protested in large numbers. One music industry veteran declared â??music is like a donut. Pay for the donut, you get to eat itâ??. Meanwhile, a 16 kid told me â??I donâ??t think you can own music – its just feelings. How can you own that?â?? So whoâ??s right? Is culture a product? Will the next generation ever settle for anything less than free? Thats what I want to explore in this documentary, which is tentatively titled Basement Tapes.

Secret Numbers

Have you been following the recent blog craze on the topic of Digg and the HD DVD key? Basically the Digg team deleted a story that linked to the decryption key for HD DVDs after receiving a take down demand and all hell broke loose. More stories appeared and were deleted, and users posting the stories were suspended.

Naturally this just made things more exciting and the number now appears on over 50 000 websites, as a set of colors, a poem and at least one t-shirt!

Many of the blogs reporting this news have been in anguish over the fact that numbers should not be copyrightable but this is acutally missing the point. Fred von Lohmann (EFF) clarifies the situation in a neatly written post:

Is the key copyrightable? It doesn’t matter. The AACS-LA takedown letter is not claiming that the key is copyrightable, but rather that it is (or is a component of) a circumvention technology. The DMCA does not require that a circumvention technology be, itself, copyrightable to enjoy protection.

Economist Against DRM

Not bad. The Economist is against DRM making bold statements in a recent article:

Belatedly, music executives have come to realise that DRM simply doesnâ??t work. It is supposed to stop unauthorised copying, but no copy-protection system has yet been devised that cannot be easily defeated. All it does is make life difficult for paying customers, while having little or no effect on clandestine copying plants that churn out pirate copies.

and

While most of todayâ??s DRM schemes that come embedded on CDs and DVDs are likely to disappear over the next year or two, the need to protect copyrighted music and video will remain. Fortunately, there are better ways of doing this than treating customers as if they were criminals.

Nice to see that serious media has begun to realise that rhetoric alone is not enough to legitimize DRM. Articles such as this show that media is beginning to practice journalism and report not only what is written in corporate press releases but are looking at what is happening all around them.

Libraries and Copyright

Copyright has a tendency to make library work difficult. This is a growing trend and many of the larger libraries in the world are struggling to come to terms with copyright issues.

Yesterday the EU’s High Level Expert Group on Digital Libraries – which includes, inter alia, stakeholders from the British Library, the Deutsche Nationalbibliothek, the Federation of European Publishers and Google – presented an advisory report on copyright issues to the European Commission.

The group also discussed how to ensure more open access to scientific research and how to improve public-private cooperation. The work of the High Level Group is part of the European Commission’s efforts to make Europe’s rich cultural and scientific heritage available online. For this purpose, the group advises the Commission on issues regarding digitisation, online accessibility and digital preservation of cultural material.

Stallman in Göteborg

This is really cool. Richard Stallman will be giving a lecture in Göteborg in May.

Free Software and Beyond: Human Rights in the Use of Software and Other Published Works

Dr. Richard Stallman will speak about the goals and philosophy of the Free Software Movement: defending essential freedoms for the users of software. In addition, he will address how the ideas of free software do or don’t extend to other kinds of published works. He will also explain what the Pirate Party must change in its program to avoid unintended negative consequences in the software field.

Dr. Stallman is the founder of the GNU project and president of the Free Software Foundation. He has received an honorary doctorate from the Royal Institute of Technology, the University of Glasgow, Free University of Brussels and Universidad Nacional de Salta. In 1990, he was the receiver of a Macarthur foundation fellowship and has been elected member of the US National Academy of Engineering and the American Academy of Arts and Sciences.
