Disrespectful handling of digitalized cultural artifacts
On several occasions I have had the opportunity to discuss digitalization of traditional media. In particular to images that are no longer covered by copyright. Those who act as caretakers and gatekeepers for these cultural treasures have long been positive to digitalization – but were quick to discover that digitalization alone is not enough. The turning point of public opinion occurred when the Library of Congress began its pilot project with Flickr in the Flickr Commons. Despite the anecdotal evidence, the gut feeling and the report some gatekeepers are still concerned about what will happen to “their” images if the plebeian mass can access them freely.
At first I thought their fears stemmed from a loss of income from selling prints, but this seems not to be their main concern even if some do refer to this. There main concern is the way in which the images will be treated.
They fear the disrespectful handling of digitalized cultural artifacts.
Now you may well ask yourselves how a digitalized artifact may be manhandled? Obviously it is not about destruction but there are concerns about use. The legal protection is long gone. The photographs are long since in the public domain and can be used and abused at will. This is of concern to the caretakers/gatekeepers since they have been entrusted with the images in physical form. In almost all cases they have received the photographs with a promise that they are preserving a part of cultural heritage. They believe that in their role as cultural preservers lies a duty to ensure that the photographers honor is not sullied by disagreeable online use.
And they know all too well that once digitalization and access has been granted there is no longer any control.
While I am a copyright minimalist and I think our protection terms are way too long I do feel there is a point here. How can museums and archives fulfill their duty to preserve what they have received in trust while maintaining their duty to provide access to culture?
Then I look at the work done by the Swedish National Heritage Board in relation to this question. They have put a small selection of their images on the Flickr Commons. A mere 274 photographs by Carl Curman (1833-1913).
The photographs have been accessed over 200 000 time since 17 March this year, that’s less than four months! Or 50 000 views per month (K-Blogg).
Besides pushing the almost unknown Carl Curman to a portion of internet fame the project at the Swedish National Heritage Board has brought back to life a set of dead photographs. Image how many times a photograph is seen in it’s lifetime. The average must be depressingly low. The most popular photograph in their project has been viewed 7805 times. Stop. Read the numbers and think. Seven thousand eight hundred and five times.

Sure the photo will be ripped off. It will be posted on websites, stored on computers, used in presentations and the name of Carl Curman will be disassociated from the picture he took. Even more certain is that the Swedish Cultural Heritage Board will not be attributed enough for their thankless task of bringing this dead cultural artifact to life. But let us remember the old adage – no good dead goes unpunished.
The role of the caretaker/gatekeeper is, not a they once believed it to be, to prevent access. In the real world, grubby fingers and clumsy handling destroy the real artifact and lose it to the whole world. That is why we should be kept away from the real thing. But in the digital world the same is not true. What the flickr commons shows beyond a doubt is that while digitalization is good, it is nothing without access.

Regulating Images
There is a very interesting article by Chris Colin over at SFgate called Nasty as they wanna be? Policing Flickr.com it’s about the group that attempts to maintain order and rules among Fickrs thirty million members who have posted 2.8 billion images.
At first glance this parallel society has been made, quite literally, in the image of our own. But in truth it’s more like a Photoshopped image — the nice parts accentuated, the inappropriate bits cropped away. So it goes with any online community, of course. Behavior must be moderated and a communal ethos must be preserved; Wild West cliches aside, total freedom at any entity like this would sink it in a storm of lawsuits, flame wars and gridlocked cacophony. So directors of community exist. And while the job of nurturing and policing any online realm would make for a fascinating study, I was particularly curious about how it worked at Flickr.
The interesting part of the article on regulation of social content is the fact that no matter how far along we have come, no matter how many articles are written and read, the state of regulation of social matter will not be resolved in a final manner.
Guidelines such as Flickr’s community guidlines, as vague and inadequate as they may seem, are probably the best way to go. My favorite rule among the guidelines is: “Don’t be creepy. You know the guy. Don’t be that guy.” It’s not the way in which laws can be written but as the rule itself says we know what they mean. These types of rules and a certain level of benevolent dictatorship by an adequate superuser, owner or group.
Champ, for her part, has no qualms defending “the Flickrness of Flickr.” A while back a group calling itself “Islam is Hell on Earth” was removed. Champ is unapologetic: “We don’t need to be the photo-sharing site for all people. We don’t need to take all comers. It’s important to me that Flickr was built on certain principles.”
Not everyone is going to be happy but it is important to remember what we often forget and that is that Flickr is not there for a community. They are there because their customers pay them. If any small group of customers threaten Flickr’s income then they will be removed. This is not democracy – it is business. Unfortunately some users forget this point.
CC photos of Göteborg on Flickr
Flickr has over 2 billion images – that’s a lot. If you type in the search term ”Göteborg” – my home town – suddenly you have the more manageable number of 66 804 hits. Of these 13 820 images are available under one of the six Creative Commons licenses which allow others to reuse the images.
The reason I know these numbers is that I have been doing some preparatory work for a project. I have looked through the 13 820 images and chosen 279 of them.
Censorship on Flickr
Since I put many of my photo’s on Flickr I was disturbed to read the following story. The more I thought about it the more I realised that it was obvious that Flickr would have the same types of rules as all the other social networking sites but it is still a reason for concern.
Photographer Maarten Dors (his Flickr Profile) received the following email from Flickr concerning a picture if a young boy smoking (Would like put it online here if I had permission… hint hint).

According to Reason Magazine, Dors argued that the photo was not a glorification of smoking but a documentation of living condition in less prosperous countries. This somehow was motivation enough for Flickr to return the photo online. Then, apparently, another employee who was unfamiliar with the exception took it down again. Which was followed by someone else from Flickr returning the image again.
Even though I know better I sometimes get fooled into thinking that sites and services on the Internet are public “goods” services which we all can use and abuse on an equal and fair footing. Naturally this isn’t so. Flickr is, like all other online businesses, online for profit. They have no interest in protecting user rights – in fact if user rights conflict with profits they have a duty towards the shareholders to maximize profits and damn the users.
Naturally we as users have legally agreed to the rights of companies such as Flickr to behave in this way when we clicked on the “I Agree” button.
But, and this is a big but, the legal status of these agreements can be questioned.
I have commented the inequality, injustice and the ways in which we could argue against such agreements in my research but it can all be summed up in the with the idea that the agreements we sign cannot be binding if they are the product of a mix of encouraged misunderstanding and misdirection. By creating an environment of openness the companies should not be allowed to impose draconian user terms on their own customers.
However this is an argument from a human rights perspective and no matter how much we like them, most courts still prefer the security and predictability of contract law. So until the courts develop a sense of courage they tend to praise but not emulate the users of all technology are at risk through the licensing agreements they are forced to sign.
Flickr Growth
Media Culpa is an interesting media blog which also includes following Flickr. Since I use Flickr in lectures I find this very helpful. Here is the latest on Flickr growth from Media Culpa.
On May 17, 2008, the 2,500,000,000th photo was uploaded to Flickr (photo here). If we look at previous milestones, it appears that the growth of Flickr could be slowing down. In November last year I wrote that the first billion photos took three and a half years while the second billion took three months. Now we can assume that it took six months to get the next half a billion photos.
I have compiled the graph below out of data directly from Flickr by checking a series of photos to find the date they were uploaded and hopefully they are correct. Regarding the growth, we know that much of the explosive increase during mid 2007 (from June and three months forward) was due to the migration of photos from Yahoo Photos. But despite the fact that Yahoo Photos supposedly had 2 billion photos, the figures suggest that far less than 1 billion were migrated into Flickr.
So, while I don’t have any official figures from Flickr, it does not seem that the organic growth is keeping the same pace as it did in the fall last year. It will be interesting to keep an eye on the development the coming six months for Flickr.
