On Thursday I will be lecturing at the London School of Economics (LSE) on a course entitled Intellectual Property Law and Policy. The focus of my 1,5 hour talk will be on

1.    Peer-to-Peer Systems and Copyright Infringement
2.    The Rise of Copyleft, the Free Software Foundation and The Creative Commons Project

Even though I did not pick the topics, these are subjects close to my heart and the broad sweep of topics should make the lecture an interesting discussion rather than just getting stuck in the individual details.

Point 1 is the development of technology while point 2 refers to the development of social systems to ensure that the technology does not deprive users of basic freedoms enjoyed prior to the advent of the technology.

Serendipity

Serendipity is making fortunate discoveries by accident. It is also one of those words that both sounds good and denotes a good thing.

While looking for the bibliographic data on Lawrence Rosenâ??s book â??Open Source Licensing: Software Freedom and Intellectual Property Lawâ?? (itâ??s the best on FOSS licensing and it’s also online here), I came across another Lawrence Rosen and his new book â??Law as Cultureâ??. The title was enough â?? I bought it.

Now that I have the book I read the front flap of the dust jacket:

Law is integral to culture, and culture to law. Often considered a distinctive domain with strange rules and stranger language, law is actually a part of a cultureâ??s way of expressing its sense of the order of things.

Rosen is a legal anthropologist and he presents a nice intro to the area of law and culture. All this is good stuff and I am looking forward to reading the rest. How did this book end up in my library and on my â??must readâ?? list? A case of mixed identity, two authors with the same name, an interest in software licensingâ?¦

Serendipity isnâ??t it great?

Michael of Rhodes

It sounds like a fictional mystery â?? just look at the ingredients: a lost manuscript about an ancient mariner sailing the Mediterranean (and beyond), fighting naval battles and piratesâ?¦

At the age of 16, Michael of Rhodes signed onto a Venetian galley in 1401 as a common oarsman. Over the next four decades he sailed on dozens of voyages, either in the war galleys of the Venetian navy, or in the commercial galleys of the merchant fleet. He rose in the ranks, attaining a number of different offices, including the highest rank a non-noble could have in Venetian service. In 1434, Michael sat down to write out the manuscript for which he is remembered. The Michael of Rhodes manuscript was lost for 400 years until it resurfaced in 1966 and again in 2000.

Today selected pages of the beautiful work are available online along with maps and illustrations. It’s not all there and it’s not CC licensed (or similar) but it’s a great site.

Summer progress

It’s a hot summer. Brains are melting and work is sluggish. Despite this deadlines loom over us the unrelenting sunshine. My PhD thesis defence is on the 2 October. The book goes to the publishers in the last week of August.

The title of the work is “Disruptive Technology – Effects of Technology Regulation on Democracy” and it will be available under a Creative Commons Attribution-NonCommercial-ShareAlike 2.5 License. The blurb on the back cover will have this text:

Social interaction is partly shaped by technology being used. Therefore technological innovation affects modes of social interaction. While gradual technological innovation is often assimilated, some changes can be more disruptive. This research examines the democratic impact of attempts to control disruptive technology through regulation. This is done by studying attempts to regulate the phenomena of online civil disobedience, viruses, spyware, online games, software standards and Internet censorship â?? in particular the affect of these regulatory attempts on the core democratic values of Participation, Communication, Integrity, Property, Access and Autonomy. By studying the attempts to regulate the disruptive effects of Internet technology and the consequences of these regulatory attempts on the IT-based participatory democracy this work shows that the regulation of technology is the regulation of democracy.

Identity Cards

Sweden was an early adopter of identity cards and individual identity numbers. This has had the effect that few people today actually question the ability of technology to invade privacy. The EU Commission has decided that Europe is to move towards biometric passports within three years. Not surprisingly Sweden has said nothing. The UK on the other hand has been active in the discussion against ID cards with anti-ID card campaigns and organisations (such as NO2ID). An unfavourable report was presented in 2005 by researchers at the London School of Economics.

The UK concerns about privacy seem a bit odd considering the amount of CCTV employed in surveillance â?? it just goes to show that accepting (?) one form of privacy invasion does not mean that people are prepared to accept them all.

In Canada The Globalization of Personal Data Project (GPD) in association with the Surveillance Project at Queen’s University will be holding an interesting workshop: National ID Card Systems to be held in June 7-9 2007. Abstracts due 21 August.

Background: The EC to invest in Free Software promotion and education
The European Commission is directing more and more money to promote the use of Free Software and Open Standards, which is a strategic objective within the IST (Information Society Technologies) Programme. The EC has signed a contract for this purpose with the SELF Consortium, a group of universities and free software advocates in seven countries, including Bulgaria, Argentina and India. The SELF project will receive funding for the startup period (of two years) of about 1 million euro.

A short intro on the SELF project
SELF (Science, Education and Learning in Freedom) is an international project that aims to provide a platform for the collaborative sharing and creation of open educational and training materials about Free Software and Open Standards. First of all, it will provide information, educational and training materials on Free Software and Open Standards presented in different languages and forms.
Secondly, it will offer a platform for the evaluation, adaptation, creation and translation of these materials. The production process of such materials will be based on the organisational model of Wikipedia.

Ending the cold war

Hey â?? remember the cold war? Itâ??s over right? When a war ends it would be nice if the warring factions could pick up all their stuff and move it back to were it belongs. Despite this (obvious?) point the US maintains 480 nuclear weapons in Europe (Germany, UK, Belgium, Netherlands, Italy, and Turkey). Formally these are NATO but they are owned and controlled by the US. It would be really nice if the US would take them back home.

The weapons are placed on European soil and if anything goes wrong the damage will be carried by Europeans. They were designed as a deterrent â?? at least that was what we where told the arms race was for. So now that there is no major power to deter (if there ever was a need for nuclear deterrent) please take the crap off our front lawn.

Why not do something really wild and make Europe a Nuclear Weapons Free Zone?

The Weapons of Mass Destruction Commission (WMDC) released its report entitled Weapons of Terror: Freeing the World of Nuclear, Biological and Chemical Arms read about the report launch here.

Commission Chairman Dr. Hans Blix presented it [the report] to the United Nations Secretary-General Kofi Annan at the UN Headquarters in New York, and thereafter to the President of the United Nations General Assembly, the Minister for Foreign Affairs of Sweden, Mr. Jan Eliasson, to whom Dr. Blix expressed his and the Commissionâ??s gratitude to the Swedish Government for having established and assumed the main financial responsibility of the WMDC.

The report calls for (amongst other things) the removal of nuclear arms in Europe.

The report clearly states that the nuclear weapon states are in breach of their Non Proliferation Treaty (NPT) commitment to disarm and “no longer seem to take their commitment to nuclear disarmament seriously – even though this was an essential part of the NPT bargain, both at the treaty’s birth in 1968 and when it was extended indefinitely in 1995.”

That’s the kind of thing we have been saying for decades – but which rarely features in the UN Security Council, dominated as it is by the five permanent members, all of whom possess nuclear weapons.  Far from disarming, they’re actually upgrading their arsenals.

The report also observes:

While the reaction of most states to the treaty violations was to strengthen and develop the existing treaties and institutions, the US, the sole superpower, has looked more to its own military power for remedies. The US National Security Strategy of 2002 made it clear that the US would feel free to use armed force without authorization of the United Nations Security Council to counter not only an actual or imminent attack involving WMD but also a WMD threat that might be uncertain as to time and place.

What are you reading this summer?

Summer is the time of relaxing but its also a time of stress – its the time when all those things that you have put of until summer must be fulfilled. One of these todo lists is the summer reading list. Here is what the summer has carried with it in terms of interesting literature:

Dave Taylor’s “Learning Unix” – yupp, as I have already written…it’s time to learn unix. I have been meaning to read Hannah Arendt so now her books “Totalitarianism” and “On Revolution” are part of the holiday. The technology section includes Adam Greenfield’s new book “Everyware“, Lasica’s “Darknet“, Langdon Winner’s “The Whale and the Reactor” (which I have meaning to reread) and Joseph Gies “Cathedral, Forge and Waterwheel“. In addition to this I have a copy of the PhD dissertation “Being-with Information Technology” by Anna Croon Fors.

So what is everyone else reading?

Technology and Public Sphere

An exciting PhD seminar is to be held by the University of Bergen (14-17 November 2006)
The PhD seminar will focus on the works of John Dewey, Marshall McLuhan and Jürgen Habermas in addition to a range of contemporary writers. The session at the University of Bergen will discuss the main topics during plenary sessions and debates, in parallel panel sessions and study groups, and in the evenings. Professor Andrew Feenberg (Canada) and professor Brian Winston (UK) have confirmed their presence during the course.

Practical information:
Doctoral students from all European countries are invited. The course is free of charge. Non-Norwegian students will be given a travel refund of 300 euro upon completion of the course. Lunch and coffee are served every day complementary of the organizers.

All students must write papers related to our topics. A first draft must be written before November 1st, and after reviews and critique during the seminar, the final version should be handed in by January 1st 2007. The course gives 10 ECTS points for the participants, and a diploma will be issued for those who complete.

If you are interested, please contact chief organizer Lars.Nyre@infomedia.uib.no before September 1st, 2006, and include a paper abstract of 500 words. The abstract should contain a description of your area of interest, method and theory. The criteria for selection of participants will be strictly academic, and the list of participants will be published on September 2nd, 2006.
