Avoiding copyright extemism…

Lessig presented a very interesting talk entitled Three stories and an argument at TED recently. It’s well worth watching for both it’s content and delivery. The basic argument is familiar. Since digital technology and tools are becoming cheaper and easier to use the cost of producing and remixing copyrighted material is becoming very cheap. Add to this the cheap availability of an efficient communications platform (the Internet with its applications) large groups of people are moving from cultural consumers to becoming consumer/producers.

Professional creators in the past (musicians, authors, filmmakers etc) have always taken culture and remixed it. Taken different ideas and re-packaged them in order to create something new. Most of our ideas have not emerged in great leaps but in many small (inevitable?) steps. Today the technology is making this process more democratic in that the amateur is invading the realm of the professional – and, as Lessig puts it, this does not mean that the material produced is amateurish. It refers to amateur in the true sense of the word it is done out of love rather than money.

The major barrier to all this is copyright law. The problem with this is that the ability to take parts of our culture and remix them is an accepted form of communication among large groups of people and the institutional response has been criminalization. Copyright law has produced the presumption that remixing is illegal in particular in the digital realm. Since every use of culture in the digital realm entails a copy therefore every use should require permission.

This is an inefficient system that goes against the way in which people act. We are developing a system where people are aware that they are acting in violation to the law but they do not feel that this is wrong. Lessig warns about the growth of copyright extremism on both sides: One side builds new technologies to protect copies while the opponent cry out for the abolition of copyright.

Much of my time is spent advising university lecturers on the ways in which they can and cannot use new technologies in the classroom. The university of today is required to connect and compete with a generation of people who are connected and digitally sophisticated. In our attempts to connect and educate we provide students with laptops, wireless connectivity and digital material.

In all this copyright is creating a barrier to effective use of ICT in education. Lecturers and students attempting to benefit from online material are being driven to acting against the law. Copyright law limits the use of web2.0 technologies such as Blogs, YouTube and Flickr in the lecture halls, but the need to connect and educate is driving dedicated lecturers to circumvent, avoid, bend and break the law. This is not a good situation.

The problem is that the law has become inadequate for our needs. In order to ensure copyright control the legislator has forgotten to allow people to remix and to allow educators to use copyrighted material to a greater extent. This is not an argument for making mass copies of the latest Hollywood film – “pure” copyright “piracy” is, and should be, illegal.

But there is a need to allow access to culture beyond the passive consumer role. It also makes good business and democratic sense since it takes the edge away from the extremist positions, which threaten to push the discussions into chaos – as extremism, does. It is an argument to allow non commercial uses of copyrighted material without the fear of reprisals which exists today.

Dutch Innovation

The Dutch collecting societies support CC – this is a great leap forward, I cannot help but wonder what the Swedish societies will do now? Probably try to continue to ignore technology, innovation, the commons, and reality…

On August 23, 2007, Dutch collecting societies Buma and Stemra and Creative Commons Netherlands launched a pilot project that seeks to provide Dutch musicians with more opportunities to promote their own repertoire. This project enables members of Buma/Stemra to use the 3 non-commercial CC licenses for non-commercial distribution of their works. It also allows Dutch composers and lyricists who already use the CC NonCommercial license to join Buma/Stemra and have them collect their royalties for commercial use of their works.

Before now Dutch authors have not been able to make their work available online under the CC NC license while at the same time having Buma/Stemra collect their royalties for commercial use of those works. The Netherlands is the first country to bring such a collaboration between a music copyright organization and Creative Commons, a move applauded by Lawrence Lessig, the founder and chairman of Creative Commons International, as “the first step towards more freedom of choice in the field of exploiting music works in the digital world.”

The Revolution is Now

The current edition of CTWatch Quarterly (August 2007) is themed The Coming Revolution in Scholarly Communications & Cyberinfrastructure.

My only problem is when does a revolution stop being coming, approaching and imminent and actually appear to be here. The Open Access movement should not be discribed as a coming event. It is here and it is spreading. But never mind my splitting of terminological hairs just read the journal. Its table of contents includes an interesting array of articles and authors. It’s available both in html and in pdf.

Wellcome Images under CC

The Wellcome Trust has released its image collection under a collection named 2000 years of human culture. Launched 20 June, Wellcome Images is the world’s leading source of images on the history of medicine, modern biomedical science and clinical medicine. All content has been made available under a Creative Commons Licence, which allows users to copy, distribute and display the image, provided the source is fully attributed and it is used for non-commercial purposes. What a show!

The final day of the iSummit and its time to sum up impressions and results. The days have been long with busses from the hotel picking us up in the morning (eight on Thursday, Friday and nine on Saturday and Sunday) and the early bus home leaving at 10pm. We have had final sessions at between 8.00-9.30pm and a full day in between.

After the final sessions there have been cultural sessions for those with the extra stamina with final shuttle busses leaving at 1 am. Naturally small break out groups continued into the small hours of the morning.

With speakers and participants like Lawrence Lessig, James Boyle, Yochai Benkler, Cory Doctorow, Joi Ito, Brian Fitzgerald & Jimmy Wales the level of knowledge and interest has been great. The participants are knowledgeable and enthusiastic all together this guaranteed a great opportunity to be inspired.

The large crowd of CC people from all over the world gave us the opportunity to compare notes, prepare ideas, discuss typical problems and generally be inspired. Some of the other CC teams are very, very impressive.

All in all it has been a great meeting.

Theories, Movement & Collected Stories

James Boyle has just given an excellent presentation on what the environmental movement did right. He points to the right mix of theory, movements and the collection of stories in the creation of the concept of the environment. The environment as a concept did not exist prior to its creation, establishment and acceptance in the wider public.

What he means is that the movement to protect public domain and develop creative commons requires more than the creation of licenses and preaching to the choir. The theory is required as a base but the broader public does not want to read theory. Therefore what is required is a movement of people to enable the transfer of dry theory in the communication to the public.

How should this be done? Well the environmental movement added a collection of stories. Individual examples of environmental damage. Burning streams, smog cities, nuclear waste and silent springs. The collection of stories have become established and iconic. They are established in the mental image of the public to such a degree that protection of the environment becomes an obvious step.

So, in order to establish the protection of the public domain, open access and creative commons the organisations working with these issues should look at the strategies of the environmental movement.

iSummit Friday

Today the iSummit (iCommons Summit 2007 in Croatia) begins in earnest. Yesterday was the legal day so today it’s the “real” thing. With keynotes and tracks till 9.30 pm. This is followed by gallery opening and a concert till after midnight. Long days with interesting people. The location today is inside the old fort called the Revelin. We are in a huge old space with limestone walls and arched ceilings and no windows. It’s brilliant, cool and dark enough to make you forget that the sun is shining outside.

iSummit begins

Today is the first day of the iSummit and we begin with the legal day with presentations by Catharina Maracke, Heather Ford, Paul Keller, Lucie Guibault and Mike Linksvayer.

The agenda is the version 3.o, international law and statistics on license use so it should be very exiting and I am looking forward to the presentations and discussions.

Dubrovnik

Tomorrow I leave for Croatia and the yearly Creative Commons meeting, the iCommons Summit, which will be held in Dubrovnik this year. This is an event that I am really looking forward to attending and I shall be blogging from the summit – so will many others be.

Harvard Thesis Repository

With so many discussions on Free Culture, Open Access and the problems connected with making academic publishing available outside academia it is surprising how few good places there are to find thesis’ online.

This is why I was happy when Peter Murray-Rust pointed me towards the Harvard College Thesis Repository (a project of Harvard College Free Culture).

Here Harvard students make their senior theses accessible to the world, for the advancement of scholarship and the widening of open access to academic research.

Too many academics still permit publishers to restrict access to their work, needlessly limitingâ??cutting in half, or worseâ??readership, research impact, and research productivity. For more background, check out our op-ed article in The Harvard Crimson.

If you’ve written a thesis in Harvard College, you’re invited to take a step toward open access right here, by uploading your thesis for the world to read. (If you’re heading for an academic career, this can even be a purely selfish moveâ??a first taste of the greater readership and greater impact that comes with open access.)
If you’re interested in what the students at (ahem) the finest university in the world have to say at the culmination of their undergraduate careers, look around.

The FAQ explains much of the process. It is also good to see that they are applying Creative Commons Attribution License

Q. What permissions do I have to grant to free my thesis?

A. To make sure your thesis is always available for scholars to build on, we ask that you give everyone permission to do the things you’d want to be able to do with a scholarly work you liked: download the work, read it, keep copies, share it with other people, and adapt it into fresh works. The specific legal permission we ask for is the Creative Commons Attribution License, the same one required by the world’s leading biology journal PLoS Biology and the other journals of the Public Library of Science.

My only (small) complaint is that I wish the repository was clearer in showing the license terms for their content. I only found it in the faq. Normally I would not bother reading the faq. To increase the usability of the site the terms should be on the download page and preferably on the essay file.
Despite this I think this is an excellent initiative and I would hope that the fact that Harvard has taken a step such as this would work as an incentive for other universities to follow suite.
